Terms of Service

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly at contact@pinginsight.com if you suspect any unauthorized use.

PingInsight monitors endpoints you configure, records the results, evaluates them against your settings, sends alerts, and renders status pages. Check intervals, monitor limits, and other capabilities depend on your plan, as described on our pricing page. We may improve, change, or discontinue features over time; if we make a material adverse change to a paid feature you rely on, we will make a reasonable effort to notify you.

You agree to use the Service only lawfully, and specifically agree that you will not:

• monitor or probe endpoints you do not own or are not authorized to monitor;
• generate abusive request volumes or use the Service to attack or overload any system;
• attempt to disrupt the Service, or degrade it for other customers;
• reverse-engineer or circumvent the Service except where the law permits;
• use the Service to store or transmit unlawful, infringing, or malicious content; or
• resell or provide the Service to third parties except as expressly permitted.

We may suspend accounts that create a security, legal, or operational risk.

Paid plans are billed in advance on a monthly or annual basis through our payment processor, Stripe. Card details are provided directly to Stripe; we do not store full card numbers. Annual plans are offered at a discount. Fees are stated exclusive of taxes, which we may add where required.

You can upgrade, downgrade, or cancel at any time from your account billing settings. Cancellation takes effect at the end of the current billing period, and the change applies going forward — except where a refund is required by law, fees already paid are non-refundable. We will give reasonable advance notice before any increase to your recurring price.

You retain ownership of the configuration, content, and data you submit to the Service (“Your Content”). You grant us a limited license to host, process, and transmit Your Content solely to operate and improve the Service. Our handling of personal data is described in our Privacy Policy. You can export your personal data and delete your account at any time from your account settings.

If you publish a status page, you are responsible for its content and for any subscribers you add or who subscribe to it. You must have a lawful basis to send notifications to those subscribers, and you must honor unsubscribe requests, which we make available on every subscription email.

We work hard to keep the Service available and accurate, but monitoring is inherently best-effort: checks depend on networks and third-party systems outside our control, and no monitoring service can guarantee that every outage is detected or that every alert is delivered. Except for any written service-level commitment that expressly applies to your plan or contract, the Service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You are responsible for configuring monitors and alerts appropriately for your needs.

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability arising out of or relating to the Service will not exceed the amounts you paid us for the Service in the twelve (12) months before the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to defend and indemnify us against claims arising from your use of the Service in violation of these Terms or applicable law, including claims related to endpoints you monitored without authorization or content you published.

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms, create a security or legal risk, or fail to pay fees when due. Upon termination, your right to use the Service ends; sections that by their nature should survive (such as billing owed, disclaimers, limitations of liability, and governing law) will survive.

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Tennessee will have exclusive jurisdiction over any dispute that is not subject to arbitration or small claims, and you consent to venue there, except where applicable law gives you the right to bring a claim elsewhere.
